Marion County Judge David Janes has denied a retrial in a sexual abuse case.
Last November, a jury convicted Jason Lambert, 37, of displaying obscene content to a minor and sexual abuse by a parent, guardian or custodian.
The defense requested a new trial because Lambert was unable to face his accuser, who happens to be a four-year-old girl.
While Lambert was babysitting the child, he showed her porn and masturbated in front of her.
The child was found incompetent to stand trial.
Judge Janes denied the request and will sentence Lambert in May.
