Marion County Grand Jury Indict 20 on Day 1

The Marion County Grand Jury indicted 20 people on Monday, Feb. 6.

The following list is provided by the Marion County Prosecuting Attorney's office.

Brian Anderson Merchant, 49, of Fairmont, was indicted on two counts of first degree robbery, two counts of assault during the commission of a felony and one count of fleeing in vehicle in reckless indifference to the safety of others.

In November, Merchant robbed the Democrat Club, stabbed two people, and led authorities on a high speed chase within a matter of hours, police said.

Kenneth James Rager, 22, of Fairmont, was indicted on one count of malicious wounding, one count of domestic battery and one count of domestic assault.

According to a criminal complaint, Kenneth Rager, 22, beat his girlfriend, who was eight months pregnant, causing her to go into premature labor.

The Fairmont Police arrested Rager on Wednesday regarding an incident that occurred Oct. 23.

Last month, police said Rager and his girlfriend were arguing over text messages sent between the two of them regarding visitation of their daughter.

Rager's girlfriend began arguing at his apartment, where according to the complaint, Rager began spitting and yelling at her.

The girlfriend told police that Rager grabbed her by her shoulders and shoved her into a high chair, causing them both to fall through a wall, the complaint said.

According to the complaint, the victim then ran outside and called police, complaining of stomach pains.

She was then taken to Fairmont General Hospital for treatment, where an emergency cesarean section was administered, the complaint said.

Doctors told police the they had to perform a cesarean section on the victim because of a tear in the placenta.

Doctors also said there was bleeding inside of the uterus, according to court documents.

Doctors delivered a boy, who was placed on oxygen at the hospital, according to the complaint.

Kenneth Hunter Sinclair, 25, of Grafton, was indicted on one count of robbery, one count of wanton endangerment, and one count of conspiracy to commit a felony.

Zachary Alen Stemple, 23, of Grafton, was indicted on one count of robbery, one count of wanton endangerment and one count of conspiracy to commit a felony.

Deputies said Sinclair and Stemple robbed a man at his apartment on Vista Hooks Drive in December.

Sinclair had a .22 caliber revolver and Stemple had a pellet pistol, according to deputies.

The men tried to steal money and prescription drugs from the victim, court documents show.

Thomas Hewitt, 52 of Farmington, was indicted on one count of threats of terrorist acts.

The Fairmont Police said Hewitt worked at the Dry Cleaning World on Fairmont Avenue.

According to the criminal complaint, Hewitt made racially charged comments to his supervisor, and threatened to kill him.

Hewitt's co-workers told police he made the same statements about killing "everyone" at work, and that they feared he would do it.

Brian Bernard Hollins, 44, of Detroit, Michigan, was indicted on one count of possession of a controlled substance with intent to deliver and one count of conspiracy to commit a felony.

Edward Wallace McCauley, Jr., 40, of Rachel, was indicted on one count of third offense domestic battery.

Amanda Dawn Kerns, 33, of Grant Town, was indicted on one count of failure to provide notice of registration changes lifetime.

Travis Jake Postlethwait, 32, of Grant Town, was indicted on one count of child neglect and one count of first offense DUI.

Roger Lee McMillen, 62, of Fairmont, was indicted on one count of second offense failure to provide notice of registration changes lifetime.

Michael P. Luckey, 46, of Fairmont, was indicted on one count of concealment of a minor child.

William Ray Hammond, 28, of Four States, was indicted on one count of grand larceny.

Paul Richard Heater, 32, of Four States, was indicted on one count of grand larceny.

Charles Jones aka Chad Jones, was indicted on one count of grand larceny.

Stacy Blair Barber, 48, of Fairmont, was indicted on one count of breaking and entering.

Stephanie Marie Shaver, 37, of Fairmont, was indicted on one count of child neglect.

Bridget Michelle Woodard, 22, of Fairmont, was indicted on one count of child neglect.

Anthony Paul Weingard, 20, of Fairmont, was indicted on one count of forgery and uttering.

Amanda Jo Waller, 29, of Fairmont, was indicted on one count burglary, one count of domestic battery and one count of petit larceny.

John Phillip Garrett, 37, of Fairmont, was indicted on one count of fleeing in a vehicle under the influence of alcohol, controlled substance or drugs, one count of fleeing in a vehicle in reckless indifference to the safety of other and one count of second offense DUI.
