The Barbour County director of emergency management charged with seven counts of misdemeanor assault was back in court Friday for a motions hearing.

Larry Allen is accused of holding an unannounced "code red drill" at Philippi Elementary School in September.

West Virginia State Police and Philippi Police said Allen put on a mask, entered the school and fired a 22 caliber starter's pistol at staff members.

Allen filed a motion to have his charges dismissed. That motion was dismissed by Judge Alan Moats.
