Federal prosecutors have charged the superintendent of the Upper Big Branch mine with conspiracy to defraud the government.

An explosion in that mine killed 29 men.

Gary May faces charges of conspiring to conceal dangers in the mine, deliberately altering approved ventilation plans and deliberately disabling a methane gas monitor.

May also faces charges of falsifying inspection books and covering up reports about deep water making a section of the mine unsafe.

May is the highest ranking Massey Energy employee to face prosecution in the blast.
