Family Members of Missing Upshur County Man Facing Charges

The brother and mother of missing Upshur County man Luke Stout are facing several criminal charges.

Kenneth Stout, 33, of Grafton is facing charges of assault on a police officer, obstructing, disorderly conduct, and carrying a deadly weapon.

Elizabeth Stout, 53, of Buckhannon is facing charges of assault on an officer, disorderly conduct, and battery on a police officer. The state police also brought up charges of battery against her.

Elizabeth Stout is charged with assaulting the girlfriend of Robert Stout, 30.

According to police documents, Buckhannon Police responded on Oct. 19 to St. Joseph's Hospital to a disruptive patient and guest.

When police arrived Kenneth Stout was loud, shouting profane language disturbing hospital staff, and other patients, according to police.

Police warned several times to Kenneth Stout to leave the property. He refused to comply with police orders, and with his attitude began making threats of harm to police and hospital staff, officials said.

Police told Kenneth Stout to place his hands behind his back, he refused. He began to take a combative stance, clinching his fist, and pulled away in attempt to strike police and hospital security staff.

Fearing serious injury, police continued to advise Kenneth Stout to place his hands behind his back, still refusing police deployed a taser. Police advised him several times again, and was tased once more, officials said.

While placing restraints on him, it was discovered that Kenneth Stout had a four inch knife concealed on his waist band, which was covered by his sweatshirt

Kenneth Stout is in the Tygart Valley Regional Jail with bail set at $50,000. He is requesting a motion to reduce bond. His hearing is scheduled for Wednesday.

Elizabeth Stout was in an Upshur County court Monday morning. Her bail was set at $35,000.

Robert Stout is facing charges of second offense domestic battery.

Robert Stout was at his mother's home when he and John Stout began to argue over their mother not going to the hospital. Robert Stout grabbed a chair, and rolled the John Stout to the ground, pulling his hair and punching him.

He is in the Tygart Valley Regional Jail, his bond was set at $35,000.
