The town of Westover may be one step closer to appealing the annexation denial of the Morgantown Mall.

During Monongalia County Commission, Commissioner Bill Bartolo released his dissenting position from September's meeting.

The commission voted 2 to 1 on August 29 denying the annexation; Bartolo voted to pass it.

Westover Mayor Dave Johnson said he's happy to hear Bartolo's stance but is still waiting to hear why the annexation was denied.

"I don't know what they could possibly put in a letter to turn this down," Johnson said. "I don't know, maybe there is some outside influence, who knows what happened there. It's just not right, that's probably why it's taking so long for them to do it. I don't know if they'll ever be able to do it."

Johnson said the town may file for writ of mandamus which will force the county to make a response.
