A Randolph County high school student was back in circuit court Thursday afternoon.
The Randolph County Board of Education filed a motion to have Olivia Hudok's case dismissed.
Hudok is fighting an immunization requirement.
The circuit court has denied that motion and said it will wait to make a decision until a similar case plays out in Kanawha County.
