A federal judge has upheld the denial of Austin Vantrease's request for a list of donors who have contributed to Ryan Diviney's care.
Ken Diviney's attorneys refused to provide the information because they said it was unnecessary and could have an effect on potential donors, who wouldn't want their personal information given to a prison inmate.
U.S. District Judge Irene Keeley said there wasn't reason to reverse U.S. Magistrate Judge John Kaull's order in a pending civil lawsuit that Ken Diviney has against Vantrease and Jonathon May for the Nov. 2009 attack that left Ryan Diviney comatose.
Vantrease and May were convicted by a Monongalia County jury in 2010.
A trial is set for July, according to Diviney's attorney, Alex Shook.
