CHARLESTON (AP) — Federal regulators have cited Consol Energy for failing to properly maintain part of a coal slurry pond where a man drowned Nov. 30, but the violation was not related to or near the site of the partial collapse.
The Mine Safety and Health Administration issued a citation on Dec. 3 but didn't provide any details until Dec. 10.
Dive teams have been working to remove a bulldozer operator who slid into the massive slurry pond during the collapse. Two other men who went in survived.
The bulldozer driver has not been identified, and the cause of the partial embankment collapse remains under investigation.
The Charleston Gazette reported the violation was related to erosion of a ditch along the access road to the impoundment at the Robinson Run preparation plant near Lumberport.
