Federal regulators have cited Consol Energy for failing to properly maintain part of the Nolan Run Slurry Impoundment at Robinson Run.

The location of the violation was not near the failure location that resulted in the death of a Consol employee on Nov. 30, according to MSHA spokesperson Amy Louvre.

The citation was issued on Dec. 3. The operator failed to maintain the Nolan Run slurry impoundment in accordance with the plan approved by the district manager, MSHA said. The rock ditch lining was not maintained in accordance with the plan. The bench/access road ditch provided along the downstream embankment of the main dam had an eroded rock lining that spanned approximately 16.5 feet, according to MSHA.

Consol announced that dive teams had located the bulldozer containing the missing Consol employee Monday. The bulldozer operator's name hasn't been released by Consol. The partial embankment collapse is under investigation.
