William Horton Jr.A Marion County man withdraws his guilty plea rather than accepting a 20 year prison sentence.
Judge Michael Aloi accepted William Horton Jr.'s plea to a charge of first degree robbery but when Aloi sentenced him to 20 years in prison, Horton said he'd rather face a jury.
A jury already has convicted Horton of conspiracy for his role in a 2010 robbery that left a man dead.
Prosecutors said Horton was the lookout while two of his friends entered David Hitchner's home, to steal drugs and money.
Hitchner shot and killed one of the robbers John Cottingham.
Horton now will stand trial on two counts each of first degree robbery and night time burglary.
