The two felony murder convictions against Phillip Reese Bush from a 1982 double homicide in Fairmont have been reversed.
Prosecuting Attorney Patrick Wilson said James P. Mazzone of the Ohio County Circuit Court granted Bush's petition for Writ of Habeas Corpus, setting aside those 1983 murder convictions and awarding him a new trial.
The order was signed about a week prior to Bush being indicted on the 1974 Windmill Park murders in Fairmont along with Eddie Washington.
Bush is accused of murdering Charles Goff and Kathleen Williams in 1982 and has been incarcerated at Mt. Olive Correctional Complex since he was convicted.
Wilson said while the court has ordered him a new trial, that decision is being appealed.
