WV Senate committee passes guidelines for arbitration

Posted: Updated:

Arbitration has been successful in West Virginia, and the Uniform Arbitration Act originated in 1955, but it could be updated.

Senate Bill 582 would provide updates to the process and serve as a guideline for how arbitration should succeed. The measure passed the Senate Judiciary Committee March 28. The full Senate will debate the bill next.

According to counsel for the committee, the original act did not address many issues that arise in modern arbitration and state statute did not provide guidance for many issues.

She also told lawmakers 35 states and the District of Columbia have adopted a similar act, and 10 more states have adopted "some form" of the act.
