A Webster County woman appeared in court Monday morning for a status hearing following the November 2012 West Virginia Supreme Court's reversal of her murder conviction and life sentence without mercy.

Julia Surbaugh, 50, was charged with first degree murder in 2010 after state police said she shot her husband, Michael, in the head three times in August 2009.

The West Virginia Supreme Court granted Surbaugh a new trial in Webster County Circuit Court. Judge Richard Facemire set Surbaugh's new trial for September 17, said Webster County Prosecuting Attorney Dwayne Vandevender.

Surbaugh remains in Central Regional Jail with bail set at $130,000.
