The Clarksburg Police Department has charged councilman Sam "Zeke" Lopez with one count of misdemeanor domestic battery, stemming from an incident involving his wife.

On April 2, Clarksburg police responded to a home in Clarksburg for a domestic call. Linda Lopez told officers that she and her husband, Sam Lopez, were involved in a verbal argument that turned physical, according to the criminal complaint.

Linda Lopez told officers that her husband grabbed her arm and pushed her to the ground, and while she was trying to defend herself, Sam Lopez grabbed a rolling pin and hit her with it on the back and arm several times, according to the criminal complaint. Linda Lopez also told officers that her husband dumped food on her while she was on the ground.

The officer on scene observed bruises and marks on Linda Lopez's arms, blood on her right wrist and food on the back of her shirt.

Officers tried to arrest Lopez on July 2 but couldn't locate him, according to the police department.

Lopez turned himself in July 3, according to Clarksburg police. He is out on bond.

The West Virginia Prosecuting Attorneys Institute assigned the case to the Marion County Prosecuting Attorney on June 3, after the Harrison County Prosecuting Attorney's Office cited a conflict of interest.

Marion County Prosecutor Elizabeth Shaw said Lopez could face up to a year in prison and a $500 fine.

Lopez was re-elected to Clarksburg City Council in June.
