A Marion County man charged with the death of an infant child made his initial court appearance in front of a Taylor County Magistrate Thursday.
Magistrate James Lucas found probable cause to bound over Marcus Curtis Lewis' case to a grand jury.
Magistrate Lucas heard testimony from a Taylor County Sheriff's Deputy who said that the state medical examiner determined the baby died from a subdural hematoma that occurred while it was shaken or thrown. The medical examiner determined that the baby died approximately two hours after the incident had taken place.
On cross examination, the defense attorney argued that Lewis said his 3-year-old daughter jumped on the infant, which caused the injuries, but the medical examiner said the child was too small to cause such severe injuries.
Lewis is being held in Tygart Valley Regional Jail.
