A Marion County man indicted on one count of first degree murder has requested a new prosecutor in his case.

Michael Palmer, 33, accused of the December 2011 death of Everett Wilson, appeared before Judge Michael Aloi Friday. Palmer's attorney filed a motion to remove Marion County Prosecuting Attorney Patrick Wilson from the case and filed a motion to grant Palmer bail or bond. Judge Aloi took the motions under advisement, said Prosecutor Patrick Wilson.

The Marion County Sheriff's Department said Everett Wilson died after his then son-in-law, Michael Palmer, shot and killed him. Everett Wilson's daughter Kristyn Palmer, and Michael Palmer were indicted by the Marion County Grand Jury for one count of first degree murder on June 6.

The trials of both Kristyn Palmer and Michael Palmer have been rescheduled numerous times. Kristyn Palmer was removed as the administrator of Everett Wilson's estate in July 2013.

Michael Palmer has a hearing scheduled in December.
