A former Upshur County Sheriff's candidate is suing the county commission and its attorney in federal court.

David Taylor filed the civil suit Monday at the Elkins office of the U.S. District Court for the Northern District of West Virginia.

Taylor names current county commission president Donnie Tenney, former commission member Creed Pletcher, current commission member J.C. Raffety, and attorney Timothy Stranko, who served as the commission's attorney, and the county commission in the suit.

Taylor charges one state law claim, negligence and five federal claims, including denial of due process by violation of the fifth and 14th amendments. 

Taylor has asked for trial by jury to hear all issues.  There's currently not a date scheduled for the case to be heard.
