Michael Palmer Appears In Court For Pre-Trial Motion Hearing

A Marion County man accused of shooting and killing his father-in-law in 2011 appeared in court on Thursday for a pre-trial motion hearing.

Prosecutors said Michael Palmer and his wife Kristyn shot and killed Everett Wilson in 2011.

Michael Palmer's attorney, Sean Murphy, presented one motion to Judge Michael Aloi.

Murphy argued that Kristyn Palmer should have to give her testimony prior to trial.

He said it falls under the marital communication and testimony privileges.

Leann Hawkins, Assistant Prosecuting Attorney, argued the defense knows what Kristyn Palmer would say due to her previous audio and written statements.

Murphy asked the state to "make an agreement" with Kristyn Palmer and have her testify before court.

"The law of presumptions and privileges applies in this case," he told Judge Aloi.

Hawkins said "if and when there is an agreement, it will be provided. But there is not one at the present time.

Two motions previously submitted by the defense are still pending.

One aims to grant Michael Palmer bond and the other is to dismiss Prosecuting Attorney, Pat Wilson, from the case.

Murphy would also like a ruling on the hear-say statements of Ed Wilson prior to his death.

Both Michael and Kristyn Palmer have been held in the North Central Regional Jail since December of 2011.

Michael Palmer will go to trial in January.
