Berkeley Springs man sentenced to 14 years in prison for having sex with an underage girl

A Berkeley Springs man has been sentenced to 14 years in prison for crossing state lines to have sex with an underage girl.

U.S. Attorney William Ihlenfeld II said Anthony Allen Pennington, 24, also faces supervision for life after pleading guilty to traveling in interstate commerce with the intent to engage in illicit sexual conduct.

Pennington had admitted to traveling to Pennsylvania in May to have sex with a 15-year-old girl. He said he'd texted the girl and made arrangements to pick up her and a friend in Morgan County. The girls rode their bikes to the designated rendezvous and Pennington picked them up and drove them to Pennsylvania, where he had sex with the 15-year-old before returning to West Virginia.

U.S District Court Judge Gina M. Groh enhanced Pennington's sentence, finding that he was a repeat and dangerous sex offender based upon his conviction in 2010 for sexual assault in the third degree in Morgan County. In the prior case, Pennington, then 20, was convicted of having sex with a female 14-year-old girl.

Pennington was remanded to the custody of U.S. Marshals pending designation to a federal prison. His case was prosecuted by Assistant U.S. Attorney Jarod J. Douglas and investigated by the Morgan County Sheriff's Department.
