A Webster County woman twice-convicted of her husband's murder is appealing the conviction.
Julia Surbaugh, 50, was charged with first degree murder in 2010 after state police said she shot her husband, Michael, in the head three times in August 2009. Surbaugh was convicted of the charge in May 2010. The West Virginia Supreme Court reversed the conviction in Nov. 12. Surbaugh was convicted on the charge by a second jury in March 2013.
Surbaugh plans to appeal the verdict, arguing the prosecution didn't prove she was solely at fault or her husband's death. A post-trial motions hearing will be held May 19, 2014.
Surbaugh is currently serving her life sentence in Central Regional Jail.
