Bordas & Bordas says appeals court affirmed $10M jury verdict

The Ohio 7th District Court of Appeals recently upheld the $10 million verdict awarded 27 months ago to two families denied insurance benefits following an April 2003 crash that claimed the life of one man and seriously injured two others.

After two weeks of testimony a jury in 2012 had found Pennsylvania-based Personal Service Insurance Company acted in bad faith when it denied Donald and Kathy Cox coverage and refused to provide them with an attorney, awarding the couple $8 million in compensatory damages plus $2 million in punitive damages.

Four days after being notified of the fatal accident PSIC refunded the Coxes their premiums, claiming it had effectively cancelled their policy more than a month before the accident. The trial judge presiding over the suit, however, found that the company's claims notwithstanding, under Ohio law the policy was in full force the day of the accident.
