The U.S. Department of Labor Wage and Hour Division's Pittsburgh District Office has ordered Vienna, West Virginia based restaurant Las Trancas Mexican Cuisine to pay more than $300,000 in back wages to 36 workers.
The workers entitled to the $365,834 in back wages have worked at the restaurant's Clarksburg and Marietta, Ohio locations. The company is also required to pay $15,520 in civil money penalties for willful and repeat violations of the Fair Labor Standards Act, according to a news release from the U.S. Department of Labor.
The Department of Labor's initial 2008 investigation revealed overtime violations at the Clarksburg restaurant. Six years later, the restaurant is still breaking the law and shorting employees, said the news release. "This continued disregard of federal wage laws will not be tolerated," said John DuMont, director of the Division of Labor's Pittsburgh office.
Investigators found Las Trancas failed to record the amount of hours servers worked and failed to pay them for any hours worked beyond 40 hours in a work week.
