An Elkins ResCare employee was arrested and charged with sexual abuse after a supervisor allegedly found him with his pants down in front of a patient.

On March 1, John Phares, Jr., 56, of Elkins, was taking care of a nonverbal mentally handicapped patient, when his supervisor returned to the home, according to West Virginia State Police.

The supervisor said she returned to take care of some paperwork. When she opened the door, she found Phares standing in front of the patient, naked from the waist down, police said. When Phares saw the supervisor, he ran in to the other room and came out with sweatpants on.

On March 4, Phares told police the patient touched him and that it was sexually arousing.

Phares is charged with second degree sexual abuse. He is currently in the Tygart Valley Regional Jail, in lieu of $10,000 bond.
