One of six people accused in a Fairmont murder appeared in Marion County Circuit Court Wednesday.
Devon Stephens faces a first-degree murder charge in the November 2016 death of Malcolm Whitted, of Detroit, Michigan. Stephens was allegedly involved in a home invasion incident that happened on Watson Avenue.
Judge Patrick Wilson denied a motion filed by the defense for a change of venue for Stephens’ trial. The defense said that the media attention the case has received, along with the conviction of Oscar Chapman, would not allow for an impartial jury to be seated. Chapman, who was also involved in the incident, was convicted of Whitted’s murder by a jury in February.
Four other people also face murder charges in Whitted’s death, including Timothy Lambert, Michelle Belton, Vanny Clay and John Deahl. Clay is set to go to trial in June, and Belton is serving prison time for the incident after agreeing to a plea deal.
Wilson also decided Wednesday that bail would still not be set for Stephens.
Stephens’ trial is set for the June term of court.
