A man was arrested after a reported sexual assault at Fairmont State University.
Devion Warnsley, 20, is accused of forcing a woman to have sex with him in her dorm room, according to Fairmont State University police.
The woman told police she and her friend went to the College Lunch and to a house party Friday night and returned to their dorm room at approximately 2 a.m. She told police Warnsley, who also came back to the dorm with them, and her friend got into an argument, and her friend left the room. Warnsley asked the woman if he could stay, and she told him he could but that he had to sleep on the floor, according to court documents.
Warnsley, then, tried to get in bed with the woman, and she told him no, police said. The woman tried to get out of bed and go to her friend’s bed to avoid Warnsley, but he pulled her back into the bed, police said. The woman said Warnsley, then, held her down by her shoulders and forced her to have sex while she continually told him no and tried to get away, according to court documents.
The woman told police that she was in shock and did not know what to do. She told Warnsley to leave, but he did not respond, she said, so she took him to his house and dropped him off. The woman told her friend about the incident and had a panic attack, police said, so they went to Fairmont Regional Medical Center. The woman told police that she was turned away because they did not have a nurse equipped to handle a sexual assault/rape kit, so she went to Ruby Memorial Hospital where a kit was performed, police said.
Warnsley is charged with second-degree sexual assault.
