White Hall Police arrest Fairmont man on drug charge

White Hall police arrested a Fairmont man Monday on a drug charge.

Police received a complaint that a man was sleeping with his legs hanging out of a car in the Walmart parking lot.

Police said they could smell marijuana coming from the vehicle while trying to wake Brian Rutherford II, 24, of Fairmont.

Rutherford looked at the officer, then laid on his hands and refused to show them to the officer, according to police.  After refusing to follow the officer’s requests, the officer used a TASER on Rutherford.  He then exited the vehicle and continue to resist arrest.

While searching Rutherford’s vehicle, police said they found approximately 25 grams of marijuana, meth, digital scales, baggies and a .38 caliber handgun.

Rutherford has been charged with possession of a controlled substance with intent to deliver.
