FAIRMONT, W.Va. – The Marion County Sheriff’s Department charged a woman after her child was found outside by himself.
On May 20, deputies went to Monongah Heights Apartments for a well-being check on a small child walking around unsupervised, according to a criminal complaint. A deputy spoke with a woman who stated that she found the 4-year-old boy behind the apartments. The woman said the boy told her he needed help finding his mother, so she took temporary custody of the boy and called law enforcement, according to the sheriff’s department.
A deputy spoke with Tonya Cain, 48, who identified herself as the boy’s mother. Cain told the deputy she left the boy unsupervised for 10 minutes. Cain also stated during a recorded statement that she had been allowing the child more freedom outside, and she let him go to the playground on his own, according to a criminal complaint. The sheriff’s department said the view of the playground is obstructed by a large tree.
The playground is approximately 50 yards from the apartment and 75 yards from Manley Chapel Road and Industrial Park Road, according to the sheriff’s department. Cain stated she was inside at the time of the incident, and two other people at the home were asleep. The boy had a gross risk of going into the road and getting hit or abducted, according to a criminal complaint.
Cain is charged with child neglect creating a substantial risk of death or serious bodily injury. She is in North Central Regional Jail.
